The Privacy Shield framework, necessitated by the earlier invalidated Safe Harbor provision, was established to provide companies from the European Union, Switzerland and the United States with a mechanism to comply with data protection requirements for transatlantic data flows. However, the recent decision revokes the Privacy Shield between the US and the EU due to the determination by the CJEU that the US lacks adequate data protection sufficient to comply with the GDPR, in some areas this lack is in direct conflict with EU data protection laws.
